Subclass 188 -Business Innovation and Investment (Provisional) Visa

 

Business Innovation Extension Stream

You may apply to extend your provisional subclass 188 visa in the Business Innovation stream for a further two years, provided you meet the relevant criteria. You must have held a subclass 188 in the Business Innovation stream for at least three years, be nominated by a State or Territory government, and have owned a business in Australia for at least two years.

The minimum requirements for the Business Innovation extension stream of this visa are as follows:

 

At the time that you apply for this visa extension, you must:

  • have held a subclass Skills Assessment visa in the Business Innovation stream for at least three years, AND
  • meet ONE of the following requirements:
  1. you continue to hold a subclass Skills Assessment visa in the Business Innovation stream OR
  2. during the COVID-19 concession period, you held a subclass Skills Assessment visa in the Business Innovation stream (this visa must have been granted before 1 July 2019) OR
  3. during the COVID-19 concession period, you held a subclass Skills Assessment visa in the NO_DATA (being the only visa you have held in this stream). You must also have been granted a subclass Skills Assessment visa in the Business Innovation stream before 1 July 2019

NOTE: The COVID-19 concession period began on 1 February 2020, and remains ongoing. To qualify for the concession, you must apply for your NO_DATA stream visa within 3 months of the end of the concession period (no date has been set for this yet).

 

You must also:

  • need to reside in Australia in order to operate your business
  • have had an ownership interest in your business(es) in Australia for at least two years (the business(es) must have been actively operating throughout this time), and be genuinely committed to maintaining this ownership interest
  • be genuinely committed to staying directly involved in the day-to-day management of your business, and to making decisions affecting its overall direction and performance
  • be nominated by an Australian State or Territory government agency
  • not have been involved in unacceptable business or investment activities (this requirement must also be satisfied by your spouse or de facto partner, if applicable)
