Subclass 188- Business Innovation and Investment (Provisional) visa

Entrepreneur Stream

The Entrepreneur stream of the subclass 188 visa provides a pathway to permanent residency for those who are undertaking (or intend to undertake) a complying entrepreneur activity in Australia. If you wish to apply for this visa, which is valid for up to five years, you must first lodge an Expression of Interest. If this is successful, and you are nominated by a State or Territory of Australia, you will be invited to lodge an application for this visa.

The minimum requirements for the Entrepreneur stream of the subclass 188 visa are set out below:

Applicant 

At the time that you are invited to apply for this visa, you must:

  • be under 55 years of age (unless your proposed complying entrepreneur activity is considered to be of exceptional economic benefit to the nominating State or Territory)
  • be nominated by an Australian State or Territory government agency

NOTE: The State/Territory government agency must also be satisfied that you (and/or your spouse or de facto partner, if applicable) have total net business and personal assets that are sufficient to allow you to settle in Australia.

  • have competent English i.e.
  • hold a valid passport issued by the UK, USA, Canada, New Zealand or the Republic of Ireland (and you are a citizen of that country) OR
  • an IELTS test score of at least 6 in EACH test component OR
  • an OET test score of at least B in EACH test component OR
  • a TOEFL iBT test score of at least 12 for listening, 13 for reading, 21 for writing and 18 for speaking OR
  • a PTE test score of at least 50 in EACH test component OR
  • a CAE test score of at least 169 in EACH test component

NOTE: In each case, the test must have been undertaken within the last three years.

In addition, you (and your spouse/de facto partner, if applicable) must have had no involvement in unacceptable business or investment activities.

Entrepreneur Activity

At the time that you are invited to apply for this visa you must be undertaking (or propose to undertake) a complying entrepreneur activity. You must also genuinely intend to undertake and continue this activity in Australia.

A complying entrepreneur activity must relate to an innovative idea that is proposed to lead to the commercialisation of a product or service in Australia, or to the development of an enterprise or business in Australia.
